Terms of Service

Pick the terms that apply to you. Buyer terms cover anyone using Cape2Cairo to find a home or send an enquiry. Agency terms cover paying agencies, agents and agency owners using the platform for their business.

For buyers, tenants and private users

Consumer Terms

These Terms apply to you if you use Cape2Cairo as a buyer, tenant, seller, landlord or private individual.

1. Acceptance

By using cape2cairo.africa you agree to these Terms. If you do not agree, please do not use the service. You must be at least 18 and able to form a binding contract in your country of residence.

2. The service

Cape2Cairo is a marketplace that helps buyers and tenants find property through listings and direct contact with local agencies. We aggregate listings from multiple agencies across several countries. We are not a party to any property transaction; all transactions happen between you and the agency or owner.

3. Your account

You can use most of the site without an account. If you create one, keep your details accurate and your credentials confidential. You are responsible for activity under your account.

You can close your account at any time from the dashboard. Closing your account triggers the deletion and anonymisation steps described in our Privacy Policy.

4. Property listings

Listings are submitted by agencies. The accuracy, completeness and availability of listing information is the responsibility of the agency. We do not independently verify listing content. Always conduct your own due diligence and engage qualified professionals (solicitor, surveyor, valuer) before entering into any transaction.

5. Enquiries and agency contact

When you submit an enquiry to an agency, we share your contact details and message with that agency so they can respond to you. From that point the agency is an independent controller of your personal data for their own follow-up, CRM and marketing activity. Their privacy policy governs that onward processing.

If you contact an agency through WhatsApp or Telegram, Meta and Telegram are also involved in handling your message. See the Privacy Policy for detail.

6. AI features

Cape2Cairo uses AI to support various platform features. AI output is informational. It is not a valuation, a legal opinion or a surveyor report. Do not rely on AI-generated information as the sole basis for a financial, legal or investment decision.

If an automated decision significantly affects you, you have a right to request human review under Article 22 UK GDPR. Email privacy@cape2cairo.africa.

7. Deed verification disclaimer

Where an agency displays a deed verification claim on their listing, the agency is accountable for its accuracy. We do not guarantee the validity of deed verification claims. Engage a qualified legal professional to confirm title before completing any transaction.

8. Your content

If you submit content to Cape2Cairo (enquiry text, saved searches, profile information), you keep ownership of it. You grant us a worldwide, non-exclusive, royalty-free licence to host, display, store and transmit that content as needed to provide the service and route your enquiries to the agency you have contacted.

9. Acceptable use

  • Do not use the platform for any unlawful purpose.
  • Do not submit false, misleading, defamatory or harassing content.
  • Do not submit enquiries on behalf of someone else without their consent.
  • Do not scrape, crawl or extract data from the platform other than for personal, non-commercial use.
  • Do not attempt to circumvent authentication, rate limits, paywalls or security controls.
  • Do not impersonate another person, agency or Cape2Cairo itself.

We may suspend or close an account that breaches these rules.

10. Payments

If you purchase credits or subscribe to a paid feature, payment is processed on behalf of Bowfell Software Ltd. Credits, featured listings and subscriptions are non-refundable. Contact billing@cape2cairo.africa for billing enquiries.

11. Intellectual property

The Cape2Cairo platform is owned by Bowfell Software Ltd or its licensors and is protected by copyright, trade mark and related rights. You may view and use the platform for your personal, non-commercial purposes. You must not copy, reproduce or distribute any part of the platform without our written consent.

12. Disclaimers

We provide the platform "as is" and "as available". To the extent permitted by law, we do not warrant that listings are accurate, current or complete; that the service will be uninterrupted, secure or error-free; or that any information on the platform will meet your particular needs.

Nothing in these Terms limits any rights you have under the UK Consumer Rights Act 2015 or any mandatory local consumer-protection law that applies to you and cannot be excluded.

13. Limitation of liability

To the extent permitted by law, we are not liable for:

  • Indirect, special, incidental or consequential loss
  • Loss of profit, business or goodwill
  • Losses arising from any property transaction, which is between you and the agency
  • Losses caused by content posted by agencies or other users

Nothing in this clause limits liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any liability that cannot be excluded by law.

14. Termination

We may suspend or close your access if you breach these Terms, if required by law, or if we stop operating the service. We will give notice where doing so does not risk further breach. You may close your account at any time.

15. Governing law and disputes

These Terms are governed by the law of England and Wales. Subject to any mandatory local consumer-protection law, courts of England and Wales have exclusive jurisdiction. Before litigation, you and we will try to resolve any dispute through good-faith discussion for at least 30 days after written notice of the dispute.

16. Changes to these Terms

Material changes will be notified to account holders by email at least 30 days before they take effect, and displayed on the website. If you do not accept a material change, you may cancel before it takes effect.
